N.L. government charged in relation to paint crew worker's death

The Newfoundland and Labrador Department of Transportation and Works is facing charges stemming from an incident two years ago which resulted in the death of a paint crew worker.

The Newfoundland and Labrador Transportation and Works department is facing charges stemming from an incident two years ago. which resulted in the death of a paint crew worker.

Wayne Wall, 41, died on impact as he was setting up road-painting signs in near the Flat Bay turnoff on the west coast on July 23, 2013.

The accident occurred six kilometres west of Flat Bay Hill.

In a news release Thursday, Service NL said the department, which employed the worker, is facing eight counts under the Occupational Health and Safety Act.

"This traffic incident has had a profound impact [Wall's family] and on the staff and crews of the department of Transportation and Works who knew and worked with Mr. Wall," said Minister David Brazil in a statement.

"Our goal is to avoid or minimize the threat of a workplace accident and department staff and crews on the province's highways play an important role in achieving this goal."

It's alleged Transportation and Works failed to provide a safe workplace, instruction and supervision, ensure effective traffic control, and ensure an occupational health and safety program was implemented.

The case will be called in provincial court in Stephenville on Sept. 21.
