No charges will be laid in the death of a jaywalking man struck by a car last Thursday, police say.

Ryan Avery Fox, 34, was hit by a Dodge Caliber at 7 a.m. while crossing Ninth Avenue S.E. in the middle of the block, near the bridge over the Elbow River.

Fox was taken to the Foothills hospital with serious injuries and later died.

Police said on Tuesday that no charges will be laid in his death.

"Unfortunately the pedestrian was crossing in an unsafe spot," said Calgary police Sgt. Wayne McCormick.

Fox stepped into traffic in the middle of the block and visibility was poor for the driver of the car, he said.

Although the temperature dropped to –24 C that morning, McCormick warned that pedestrians should not take for granted that vehicles will stop for them in poor weather.
