Crown has little to ask Marissa Shephard as testimony wraps up at her murder trial

The Crown's cross-examination of Marissa Shephard lasted all of five minutes Tuesday as testimony wrapped up at the murder trial of the 22-year-old Moncton woman.

Shephard, who gave her version of events on the night Baylee Wylie was brutally killed, was the only defence witness during the trial in Moncton Court of Queen's Bench.

She is charged with first-degree murder and arson with disregard for human life in the death of the 18-year-old Wylie, whose body was found in her burned-out townhouse on Dec.17, 2015.

Shephard spent all of Monday testifying, saying she had not taken part in the stabbing attack that killed Wylie and that sent Tyler Noel and Devin Morningstar to prison for murder.

On Tuesday, Crown prosecutor Eric Lalonde had few questions for Shephard.

He asked her if Wylie was left bleeding after she hit him in the head with a glass bong. She said yes.

He also asked Shephard what she was doing while the others set fire to her house after Wylie's death and brought belongings outside.

She said she sat at the bottom of the stairs in the living room and waited.  

Questioned by defence lawyer Alison Menard earlier, Shephard denied there had been any talk of getting intimate with Tyler Noel before the murder or that she kissed Devin Morningstar after it.

In a videotaped interview with police, Morningstar had painted a picture of an attack fuelled in part by a twisted love triangle, where both he and Noel were trying to impress Shephard. 

"Missy likes bad boys," he said in the video played during the trial.

Shephard disputed this.

"There wasn't even a discussion between me and Noel about hooking up at the house," she told the court Tuesday.

While Devin Morningstar was arrested in the days following the murder, police continued their search for Tyler Noel and Marissa Shephard. Shephard wasn't found until three months later. (RCMP)

Menard asked Shephard about surveillance video footage from after the murder that showed people milling around the inside of a convenience store.

"It looks like he's kissing me," she said, speaking of Morningstar. "But my hood is really big, and he's grabbing my face at this point. And this is where he's telling me everything's going to be OK.

"It seems as though we're kissing but he's really pulling my face. I'm really a mess in this video."

Morningstar, 20, was convicted last year of first-degree murder and Noel later pleaded guilty to second-degree murder.

Jurors in the Shephard case will not be back in court again until Friday, when they are to hear closing arguments, with the defence going first.
