Joshua Penny was hit by a caronSept. 27 while he was riding his bike around Florence with his brother.
The vehicle veered onto the sidewalk and draggedJoshua onto the street. His brother was not hurt.
Joshua was airlifted to the IWK children's hospital in Halifax, where he remained in a coma until his death Friday afternoon.
Paddy Brogan, 57, was arrested at the scene and later charged with failing a breathalyser and impaired driving.
A spokesman for Cape Breton Regional Police wouldn't say Friday whether further charges will be laid.
