Court records indicate the Oscar winner — who won this year for Milk and for 2003's Mystic River  —  filed a request on Thursday to dismiss his legal separation.

"It was an arrogant mistake," the 48-year-old performer told the New York Daily News.

The Penns first filed for divorce in December 2007 after 11 years of marriage.

The actors, who married in 1996, have two children — daughter Dylan Francis, 18, and 15-year-old son Hopper Jack.

They reconciled four months after the first filing.  But divorce papers were filed again, in late April 2008, citing irreconcilable differences.

Wright Penn, 42, is in France fulfilling her role as a juror at the Cannes Film Festival. Her roster of films includes The Princess Bride, Forrest Gump and, most recently, State of Play.
