Superior Court Judge Scott M. Gordon ruled Monday that Federline will take temporarycustody of Sean Preston, 2, and Jayden James, 1, beginning Wednesday.

On Tuesday, Spears's attorney Sorrell Trope, told People magazine that the judge granted the order after Spears failed to comply with two earlier conditions set by the court.

The judge had earlier ruled that she mustshow a valid California driver's licence andsubmit to random drug and alcohol tests.

"Specifically, the judge ordered that by 10 a.m. (Monday) morning, both parties show valid California driving licences. I've been unable to produce evidence of that," Trope said.

Trope saidthere also"was a claim by Mr. Federline's attorney that [Spears] had not complied with a previous order the court had made — before I came on board (as lawyer) — about having a random drug and alcohol test."

Celebrity newsprogramE! News reported Federline's attorney, Mark Vincent Kaplan, had told the court Spears was photographed driving with the children in a car.

Spears is already in trouble with California traffic authoritiesfor driving without a valid licence. Her driver's licence in her home state, Louisiana, hasexpired and she has yet to get a California licence.

She faces two misdemeanour charges in connectionwith an accident Aug. 6.

Lawyers for Spears and Federline returned to court last week in their ongoing custody dispute.

Earlier this month, Gordon ordered Spears to undergo random drug and alcohol testing and complete a court-sanctioned parenting course.

He said he was concerned she had engaged in "habitual, frequent and continuous use of controlled substances and alcohol."

Spears also was previously ordered to meet weekly with a "parenting coach" who was to observe and report back to the court about her parenting skills.

The pop singer split from former backup dancer Federlinelast year, and they reached an agreementforjoint custody. However, Federline is nowpressing for a greater share of custody.
