Tracy Morgan upgraded to fair condition after crash

Comedian and actor Tracy Morgan and his assistant, Jeffrey Millea, have been upgraded to fair condition after a recent highway crash in New Jersey.

Assistant's status also upgraded; fellow comedian still in critical condition

Comedian and actor Tracy Morgan and his assistant, Jeffrey Millea, have been upgraded to fair condition after a recent highway crash in New Jersey.

The former 30 Rock and Saturday Night Live star continues to show signs of improvement and "his personality is starting to come back as well," according to Morgan's spokesman, Lewis Kay.

Morgan, Millea and fellow comedians James McNair and Ardie Fuqua were travelling in a limousine van on June 7 when it was involved in a multivehicle collision on the New Jersey Turnpike.

McNair was killed in the crash. Fuqua remains hospitalized in critical condition.

Prosecutors believe that Kevin Roper's truck hit Morgan's vehicle when he swerved to avoid slowed traffic. According to a criminal complaint, the Wal-Mart delivery driver had not slept for more than 24 hours before the crash.

Roper has pleaded not guilty to charges of death by auto and assault by auto.
