Penns file for divorce 3rd time round
Oscar-winning actor Sean Penn and his wife Robin Wright Penn are headed for divorce for the third time but in this round, it's Robin who has filed the papers.
The 43-year-old actress filed for divorce on Aug. 12 in Marin County, Calif., where the couple lives.
In court documents accessed by People magazine, the papers state "both parties have already agreed to [shared] custody of their son Hopper Jack, 16, and … have already agreed to division of all property."
The documents list "irreconcilable differences" as the reason for the split.
The two, who have been married since 1996, also have another child, 18-year-old Dylan Francis.
In the latest issue of More magazine, out on Tuesday, Wright Penn said she would not reconcile again: "I hit that crossroad a while ago."
Penn, 49, had filed for divorce twice before. The first time was in December 2007, but the couple reconciled a few months later.
The actor — who captured his second Oscar in February for his portrayal of gay activist Harvey Milk in Milk — filed for legal separation earlier in 2009 but then withdrew his petition in May, saying it was an "arrogant mistake."
The couple first appeared onscreen together in 1990's State of Grace and have since done a few movies together.
Wright Penn is appearing in the upcoming movies New York, I Love You and The Private Lives of Pippa Lee.
Penn will be in Terence Malick's Tree of Life and Fair Game — portraying CIA operative Valeria Plame's husband, Joseph Wilson.
In 2003, U.S. diplomat Wilson had said the Bush administration had distorted intelligence to exaggerate the Iraqi threat. Eight days later, political columnist Robert Novak, who died on Tuesday, blew Plame's cover as an operative.
Plame's uncovering resulted in a political and judicial firestorm involving members of the Bush administration. In 2005, Vice-President Dick Cheney's former chief of staff, I. Lewis (Scooter) Libby was indicted and sentenced to 30 months in jail.
